Terms of sale
The General Conditions of Sale define the conditions applicable to sales concluded between, on the one hand, persons making a purchase via the NCMG SAS website www.ker-sun.com, hereinafter referred to as"the Customer"and on the other hand the company NCMG SAS, hereinafter referred to as"Ker-Sun"These conditions apply exclusively to non-commercial individuals.
I/Price of items and Order
All prices are indicated in euros all taxes included, excluding shipping costs (see paragraph Shipping and Delivery)
The prices of the items offered on Ker-Sun are valid for 24 hours from their publication on the site www.ker-sun.comThe items will be invoiced on the basis of the rates in effect at the time of order entry.They remain the property of Ker-Sun until full collection of the price by Ker-Sun.

The ordering process is as follows:

The Customer will be able to view during these different stages the details of his order and its total price and correct any errors, before confirming it to express his acceptance.The Customer will receive an order confirmation emailKer-Sun reserves the ownership of the items until full payment of the order, that is to say upon receipt of the price of the order by Ker-Sun Ker-Sun reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or who would present in his eyes any form of risk.
Any order implies acceptance of the prices and description of the items available for sale.Ker-Sun undertakes to honor orders received on the website only within the limits of available stocks.In the absence of availability of one or more item (s) ordered, Ker-Sun undertakes to inform the Customer as soon as possible, and if necessary to reimburse it at the latest within 14 days following the date on which he exercised his right of withdrawalThe Customer's order will then be automatically canceled.
Ker-Sun reserves the right to verify the personal data communicated by the Customer and to adopt all measures deemed necessary to verify that the person who placed the order is indeed the holder of the Customer account and/or the means payment methods used, in order to avoid any identity theft or fraudulent payment.
II/Shipping and Delivery
Same day shipping:
Ker-Sun aims to guarantee you the best lead times so that you can have your products quickly.
Except in exceptional cases, Ker-Sun ships the same day all orders placed before 12 noon from Monday to Friday.

- For orders of less than € 30 including tax, the shipping costs will be € 8.90 including tax (approximately 5 to 7 days from the date of shipment).
In Belgium and Luxembourg:
- For all orders greater than or equal to € 30 including tax:
- Delivery to a relay point via Mondial Relay is free
- Home delivery via La Poste is billed at € 4.90 incl.
- Express delivery (d + 1) via Chronopost is billed at € 11.90 incl.
- For orders under € 30 including tax:
- Delivery to a relay point via Mondial Relay is invoiced at € 3.90 incl.
- Home delivery via La Poste is billed at € 8.90 incl.
- Express delivery (d + 1) via Chronopost is billed at € 16.90 incl.
Outside France, Belgium and Luxembourg - In the European Union:
- The shipping costs are 10 € TTC in standard home deliveryThe time is different depending on the country.
- The shipping costs are 10 € TTC in standard delivery.
- Import charges may be applied by customs
Condition of the package on delivery:
The Customer is required to check the condition of the items deliveredAny anomaly concerning the items (damage, item missing from the order form, damaged or open package, broken item, etc.) must be indicated within 3 days of delivery.
Means of payment
Payment for purchases is made at the Customer's choice:

Fight against bank card fraud
Ker-Sun reserves the right to verify the personal data communicated by the Customer and to adopt all measures deemed necessary to verify that the person whose bank account is debited is indeed the one who placed the order, in order to avoid any fraudulent paymentThis verification may take the form of a request for proof of identity and/or address.The Customer's failure to respond to a request of this type within 2 days of the request made by Ker-Sun will automatically result in the cancellation of the order concerned, without any possibility of subsequent complaint.
Ker-Sun will also be free to directly cancel an order that presents one or more risk factors for fraudulent use of a bank card.
IV/Exchange, return and refund
a/Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days of receipt of the product.To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (for example, email or letter sent by post)In order for the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.
Effects of withdrawal:

At Ker-Sun the Customer has 14 days from the date of receipt of the items to inform us of their desire to return the items.For all purchases of products over € 30 including tax, return shipping costs are free if the package is returned from mainland France, Belgium or Luxembourg.In other cases, the return shipping costs are the responsibility of the customer.
This right of return within 14 days does not limit the legal rights and guarantees.
We reimburse returns in full except for shipping costs for express deliveries.
Condition of items:
All returned items must be returned perfectly intact in their original packaging and with the original labels.
Upon receipt of the package, Ker-Sun will judge the perfect condition of the returned merchandise.No return will be accepted if the returned items have been visibly used or damaged by the Customer and this use or damage renders the items unfit for sale.
Return process and conditions for refund

3We will reimburse you for all payments received without undue delay and, in any event, no later than fourteen days from the day we are informed of your decision to withdraw from this contract.We may defer reimbursement until we have received the goods or until you have provided proof of dispatch of the goods, the date chosen being that of the first of these facts.We will process the refund using the same payment method you used for the initial transaction, unless you expressly agree to a different method; in any case, this reimbursement will not incur costs for youNo cash refund will be made by Ker-Sun in the event of the return of one or more items paid for by gift card.The corresponding card will be automatically re-credited with the corresponding amount by the partner concerned.
We do not give full refunds except the shipping cost of express deliveries.
Return of the right product
The Customer must return to us the product purchased on the site www.ker-sun.com , new and unworn, for which he has exercised his right of withdrawal or his return request.If the Customer does not return the correct product, Ker-Sun will send him an email inviting him to collect it at his expense, within two months from the date of the email.After this period, Ker-Sun will consider itself owner within the meaning of article 2276, paragraph 1 of the Civil Code which provides:"In terms of furniture, possession is equivalent to title".
In addition, in the absence of return of the property subject to the right of withdrawal, Ker-Sun will reserve the right to file a complaint for breach of trust (article 314-1, paragraph 2 provides that:"Breach of trust is punishable by three years of imprisonment and a fine of 375,000 euros").

All items offered by Ker-Sun are subject to the legal guarantee provided for by articles L 217-4, et seq. Of the Consumer Code and the guarantee against hidden defects provided for in articles 1641 et seq. Of the Civil Code.
The Customer has two (2) years to assert one or other of these guaranteesFor the lack of conformity, the period starts from the issueFor hidden defects, the period starts from the discovery of the defect.

However, Ker-Sun cannot be held responsible for the misuse and/or intensive use of the items that the Customer may make of them.Likewise, Ker-Sun cannot be held responsible for the return of a competing product and/or not sold on the Site by the Customer.It is the Customer's responsibility to return the correct item.
Ker-Sun does not offer any commercial guarantee.
Ker-Sun is fully responsible towards the Client for the proper performance of the contract concluded with the Client.However, Ker-Sun cannot be held liable for the non-performance or improper performance of the contract concluded in the event of force majeure, the occurrence of an event attributable to the Customer or any inconvenience, unforeseeable and insurmountable damage inherent in the event. All texts, comments, works, illustrations and images reproduced on Ker-Sun are reserved under copyright as well as intellectual property and for the whole worldAs such and in accordance with the provisions of the intellectual property code, only use for private use is authorized, subject to different or even more restrictive provisions of the intellectual property code.Any total or partial reproduction of the Ker-Sun site is strictly prohibited without prior agreement.
According to articles L 611-1 et seq. These general conditions of use and sale are subject to French lawIn the event of a persistent disagreement on the application, interpretation and execution of these terms and conditions, and in the absence of an amicable agreement, any dispute will fall under the jurisdiction of the competent French courts.
